Xbox 360 and second console owners??

i recently purchase an xbox 360 from ebay, it had the 3 red lights and was under microsoft 3 year warranty. i send it the first time they fix the problem, when i got it back the fans where laud than the normal. i send it the second time for repairs and they took 3 weeks to send it back, but hear this. the fedex guy show up wih the box once i got it he said ok i need 47 bucks, i said what???? because microsoft don't pays for the shipping. any way i told him i'm calling microsoft to see whats the charge for. i call the repair center and i foud out that after 3 weeks the console was not fix and the guy told me that they have a policy of second console owners, that the warranty is only apply to the original owner. i was pissed off and i don't know if this is just BS from them or is a new policy that they have because i did that with 3 other consoles i bought before this is the first one i have this problem with ANY IDEAS ON WHAT CAN I DO THANKS
